Welcome to ServiceGaps (“we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the ServiceGaps platform, website, and related services (collectively, the “Service”).

By accessing or using ServiceGaps, you agree to be bound by these Terms. If you do not agree, please do not use the Service.


1. About ServiceGaps

ServiceGaps is a work shift management platform designed to help companies in the tourism, hospitality, and service industries efficiently schedule, manage, and fill shifts with their existing workforce.

ServiceGaps is not a job board, employment agency, or payroll processor. The platform provides scheduling, collaboration, and workforce management tools to support employer–employee interactions within a company’s internal team.


2. Eligibility

To use the Service, you must:

  • Be at least 18 years old.
  • Have the authority to enter into a binding agreement (if representing a company).
  • Provide accurate, complete registration information.

Employers are responsible for ensuring that all employees added to their organization are authorized to use the platform.


3. Accounts and Login

Users create an account as either:

  • Company (Employer) – to manage employees, assign shifts, and approve requests.
  • Employee – to view assigned shifts, request coverage, and view predicted earnings.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@servicegaps.com if you suspect unauthorized use.


4. Acceptable Use

You agree to use ServiceGaps only for lawful purposes. You may not:

  • Misuse or disrupt the platform’s functionality.
  • Access another company’s data without authorization.
  • Upload, distribute, or store malicious code or false information.
  • Attempt to reverse-engineer or replicate the platform.

Employers must ensure that data they enter (such as employee details or shift information) complies with applicable employment and privacy laws.


5. Subscription and Fees

Certain features may be offered on a subscription or usage-based plan. All pricing and billing terms will be communicated before activation. ServiceGaps reserves the right to modify pricing with reasonable notice.


6. Intellectual Property

All software, content, and materials within ServiceGaps—including logos, text, graphics, and design—are the intellectual property of ServiceGaps or its licensors. You may not copy, modify, or distribute these materials without written consent.


7. Data and Privacy

We collect and process limited user information to operate the platform. By using ServiceGaps, you agree to our Privacy Policy (to be published separately).
Employers are responsible for ensuring their use of employee data complies with applicable laws in their jurisdiction (including Canada’s PIPEDA or equivalent provincial laws).


8. Service Availability

We aim to provide uninterrupted access but do not guarantee that the Service will be error-free or available at all times. Maintenance, updates, or technical issues may temporarily affect availability.


9. Disclaimer of Warranties

ServiceGaps is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding:

  • The accuracy or completeness of shift or wage data.
  • The reliability of communications between employers and employees.
  • Continuous or error-free service.

Your use of the Service is at your own risk.


10. Limitation of Liability

To the maximum extent permitted by law, ServiceGaps and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the platform—including but not limited to lost wages, missed shifts, or employment disputes between users.

Employers and employees are solely responsible for their employment relationships, agreements, and compliance with labor laws.


11. Termination

We may suspend or terminate your access if you violate these Terms or engage in fraudulent or abusive activity. You may also delete your account at any time by contacting support@servicegaps.com.


12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates take effect constitutes acceptance of the revised Terms.


13. Governing Law

These Terms are governed by the laws of Canada and the Province of Alberta, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Alberta, Canada.
